Right of Withdrawal

1. You have the right to withdraw from this contract within 14 (fourteen) days without giving any reason for returning the goods.
2. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
3. To exercise the right of withdrawal, you must inform us, SIA "TavaGaisma", legal address: Pūces iela 15 - 8, Riga, LV-1082, phone number: 27117849, email address: info@tavagaisma.lv of your decision to withdraw from this contract.

Effects of withdrawal:

5. If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding the costs of delivery and additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
6. You shall send back the goods to the tavagaisma.lv warehouse at Viskaļu iela 31, Riga, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. Please note that SIA TavaGaisma has the right to record possible visual damages to the goods and the content of the package upon receipt for goods sent by express mail. In cases where, when sending goods to the SIA TavaGaisma warehouse using courier mail, SIA TavaGaisma detects damage to the goods or non-compliance of the goods with the visual condition and completeness at the time of receipt of the goods, you will be informed and a copy of the detection act will be sent to you. We recommend returning the goods in person in Riga, at Viskaļu iela 31, after agreeing on the time for returning the goods in advance. When returning goods by courier, the courier is called by the responsible person of TavaGaisma.lv, at the time of refund, the amount for the courier call will be deducted from you, the amount depends on the location in the territory of Latvia.
7. You will have to bear the direct cost of returning the goods.
8. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
9. During the withdrawal period, you have the right to use the product to the extent necessary to check the nature, characteristics and functioning of the product. (to the same extent as could be done before purchasing the product in a regular store, for example, to visually inspect the appearance of the light fixture, size, but without performing any manipulations, including not removing protective films. When exercising the right of withdrawal, you are responsible for using the product beyond the purpose of checking the nature, characteristics and functioning of the product. You are responsible for such use of the product during the withdrawal period that is incompatible with the principle of good faith, as well as for the reduction in the value, quality and safety of the product.

10. You are responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal.
11. Except in the cases specified in paragraph 12 of these rules, you can exercise the right of withdrawal and unilaterally withdraw from the contract within 14 days, covering:
    1. expenses for the delivery of the product that is not the standard delivery method offered by SIA "TavaGaisma";
    2. direct costs of returning the product, except in cases where SIA "TavaGaisma" has agreed to cover these costs or has not informed you that you have to cover the costs;
    3. decrease in the value of the product if the product has been used for a purpose other than to determine the nature, characteristics and functioning of the product. You are not responsible for the decrease in the value of the product if SIA "TavaGaisma" has not informed you about the right of withdrawal in the manner prescribed by regulatory enactments regulating consumer rights protection;

The consumer cannot use the right of withdrawal:

12. In the cases specified in paragraph 22 of the Cabinet of Ministers Regulations No. 255 of May 20, 2014 "Regulations on Distance Contracts", including if:
    • the price of the goods is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the withdrawal period;
    • the goods are made to the consumer's specifications or are clearly personalized;
    • the goods are liable to deteriorate or expire rapidly;
    • the goods, after delivery, according to their nature, are inseparably mixed with other items;
    • the consumer has requested the trader to visit for the purpose of carrying out urgent repairs or maintenance. If the trader, when arriving at the consumer, provides an additional service or supplies goods that are not necessary spare parts to carry out the repairs or maintenance, the right of withdrawal applies to the said additional services or goods;

17. SIA "TavaGaisma" informs that upon detecting a loss of value of the returned product, it will go to court with a claim for compensation of losses caused to SIA "TavaGaisma" as a result of the consumer's actions.

The complaint will be reviewed within 14 days from the date of receipt of the complaint, with the response sent to the contact address specified in the complaint.
